Terms of Service

1. Acceptance

By creating an account or using MarkPoll, you agree to these Terms of Service. MarkPoll is operated by Timothée Gauchez, trading as Likn (auto-entrepreneur), Conflans-Sainte-Honorine, France. You must be at least 18 years old to use this service.

2. The service

MarkPoll allows you to create polls and embed them as SVG images in Markdown files (e.g. GitHub READMEs). The service is provided as-is. We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

3. Your account

You are responsible for maintaining the security of your account. You may not use MarkPoll to create polls that are illegal, harassing, abusive, or otherwise harmful. We reserve the right to suspend or delete accounts that violate these terms.

4. Free plan

The free plan is provided without charge and is subject to usage limits (maximum 3 active polls simultaneously). We may change free plan limits with 30 days notice.

5. Pro plan & billing

The Pro plan is available on a monthly (€7/month) or annual (€60/year) subscription, billed via Stripe. Prices are inclusive of applicable VAT.

• Monthly subscriptions are non-refundable. You may cancel at any time; access continues until the end of the current billing period.
• Annual subscriptions are eligible for a full refund if requested within 14 days of the purchase date. After 14 days, no refund is issued and access continues until the end of the annual period.

To request a refund, email support-markpoll@oxoghost.dev with your account email and purchase date. Refunds are processed via Stripe within 5–10 business days.

6. Vote integrity

MarkPoll implements best-effort duplicate vote prevention using IP/User-Agent hashing and signed cookies. These measures are not foolproof. Polls are intended for lightweight community input and should not be used for binding decisions, elections, or any context requiring verified voting.

7. Intellectual property

You retain ownership of all poll content you create. By using MarkPoll, you grant us a limited licence to store and display your content as necessary to operate the service. We do not claim any ownership over your data.

8. Limitation of liability

To the maximum extent permitted by French law, Likn shall not be liable for any indirect, incidental, or consequential damages arising from your use of MarkPoll. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Governing law

These terms are governed by French law. Any disputes shall be subject to the exclusive jurisdiction of the courts of France.
